For 18 months now, the Association of Local Authorities for Digital Technology Avicca, the federation of industrialists InfraNum and the France THD Mission have been working on the overhaul of the Grace THD data exchange format. A revised and corrected "v3" that will become the future standard for public fibre optic networks.

 

The promises of Grace THD V3: "the harmonisation and standardisation of data exchange practices between private and public players" are one of the conditions for "industrialising deployments". In order to meet the objectives of the France THD Plan, the ambition is to return as soon as possible to 2019 production rates.

This common frame of reference also aims at enabling local authorities to constitute a reliable and exploitable base for their public initiative networks.

 

A recommendation of the France THD Plan, accompanied by an application guide, will help promote the adoption of this model. Thus, "the France THD Mission recommends to all local authorities to migrate to GraceTHD v3" in the operational phase. While in the deployment phase, "the migration will be decided by the local authority under the aegis of the MTHD, after consultation with the local and national private stakeholders concerned".

While the 4G deployment figures had remained within the norm in March and April 2020, the stall finally occurred in May. 330 new sites brought into service by Orange, SFR, Bouygues Telecom and Free according to data from the French National Frequencies Agency. The figure is relatively low but remains higher than last February or spring-summer 2019.

 

Nevertheless, the breakdown by operator shows a significant slowdown on the part of Orange and Free. The locomotives of the deployment over the past year respectively brought 154 and 230 new 4G sites into service in May, well below the pace observed in recent months. This slowdown cannot help but be associated with the health crisis. Operators have reported various difficulties during containment.

What's more, the number of new activated antennas is down 20 to 50% compared to the previous month at Free and Orange. Antenna activations on their current flagship bands have reached the lowest levels seen in a long time, 18 to 24 months in some cases.

There was also a general decline in the number of authorizations obtained by Free and 4G in 700 MHz. The number of authorizations received by Iliad's brand in this band, which has usually fluctuated between 500 and 1,000 per month for the past year, plunged to less than 200 in May.

 

At first glance, SFR and Bouygues Telecom appear to have been less affected by the disruptions despite a decline in activations and authorizations on several frequency bands. However, it is difficult to draw conclusions from this, as the pace of deployment of these two operators has been irregular for several months. It should be noted that only SFR seems to have felt the need to make extensive use of the derogatory mechanism put in place by the State to ensure the continuity of deployments, on 58 occasions.

With 155 new 4G media in service, Bouygues Telecom achieved its best month since December in May. In terms of antennas too, the operator set a six-month record: 556 more in May. Of these, 313 were in the 1,800 MHz frequency band, notably to serve a number of major cities (Paris, Lille), several major roads and seaside resorts, according to ANFR.

Organized by Mon Territoire Numérique every year in March in Deauville, the RIP Estates General finally took place in video format. At the end of March, InfraNum warned that a complete halt to the fibre optic deployment projects would be a "catastrophe" likely to cause 12 months of inertia. Today, the Federation of Digital Infrastructure Industrialists is breathing - a little. At any rate, these are the figures announced by Julien Denormandie, the French Minister for Urban Affairs and Housing, who has been in charge of HSBB issues since 2017. But Etienne Dugas warns that they should be taken with caution: "In terms of productivity, we are still far from the rates we could have had previously".

This observation is corroborated by Lionel Recorbet for SFR FttH: "We are going to have a lot, a lot of difficulties to get back to 100%". Cyril Luneau, Director of Community Relations at Orange, also warns that a return to pre-crisis fibre deployment levels "is not for now". The Covid episode will have "a serious and profound impact on the calendars and milestones for the end of this year, and no doubt for 2022", i.e. the deadlines for the operator's commitment in the AMII zone.

 

The operators therefore warn that at this stage it is difficult to quantify the additional delays. Pascal Rialland, President of Covage, nevertheless risks predicting a postponement of deployment of "4 to 6 months in 2021" for the 75,000 fibre optic lines that Covage was to deploy in 2020 in Calvados.

Schedule slippages will be inevitable and consequently delays in commercialization could ultimately weigh on the economy of the projects carried by the communities. As will the more immediate additional costs associated with health precautions.

It is not possible at this stage to put a figure on these additional costs. InfraNum has also commissioned an impact study for the end of the month. The Federation of Industrialists intends to use this work as a basis for the recovery plan promised by the government for next September.

 

While waiting for a clearer picture of the impact of the health crisis, the participants in the Estates General of the RIPs preferred to insist on other levers for accelerating deployment in order to respond to the digital impatience.

On the industrial side, the immediate cash needs of companies in the sector were highlighted in order to be able to continue their activity. At the height of the crisis, infrastructure operators have multiplied initiatives to relieve the cash flow of their subcontractors (reductions in payment deadlines, advances and other subsidies). Now, the idea is to "put more agility" in the payments of France THD subsidies to local authorities, Julien Denormandie announces.

But the President of the French Telecoms Federation, Arthur Dreyfuss, tempers "the answer cannot only be public money". Beyond new financial help, the Secretary General of Altice France is waiting for "all those little everyday obstacles" to the deployment of fibre to be lifted. Many grievances have been voiced for years that many HSBB actors would like to see finally heard. In this exceptional situation, "we have to beat the iron", Patrick Chaize sums up. By making, for example, digital infrastructures an essential asset, argues the Senator of Ain and President of Avicca. An approach allowing the deployment to overcome some of these obstacles, also believes Arthur Dreyfuss, deploring that "we do not benefit from the right that gas or electricity enjoy.

An idea that does not convince Julien Denormandie, for whom such a status could be misunderstood by the French deprived of a good connection. The minister prefers to go through other texts for certain operational advances to which he says he is "open". On the other hand, concerning the very pressing question of co-ownership, the minister kicks the ball, referring to the "balances" of the Elan law. "Unrealistic" goals in fiber deployment?

To estimate the number of premises to be connected to fibre optics in France, the Arcep has hitherto relied on INSEE data. However, a few days ago, the contours became clearer with the integration into its data of the IPE (Information Préalable Enrichée) files from the operators. This information has long been requested by the Association of Local Authorities for the Digital Economy (Avicca) and which it hastened to examine.

 

The result: of the 9,000 municipalities for which the IPE files are now authentic, the number of premises is much higher than previously estimated. In particular in the AMII zone, a notorious casus belli between the operators who deploy there and Avicca. Avicca counted "1.82 million premises not accounted for" in the old reference system, which was set at around 13.5 million. Orange and SFR made binding commitments to the government on this basis. By this yardstick, "objectives that already seemed unattainable - even before the current health crisis - now seem unrealistic," comments Avicca.

 

In order to take into account the strong disruptions caused by the health crisis, the association is calling for a "freeze" on the timetable, but "Covid-19 could not be held solely responsible for all the delays that Avicca and Arcep have been measuring for years", it continues. In the other zones, the additional premises are more limited. The objective is to cope with the high demand on the networks - voice and data - and the new geographical situation brought about by confinement.

The emergency law voted to deal with the consequences of the coronavirus epidemic includes a digital infrastructure component for mobile operators. They will be able to use a "simplified procedure for sites that will ensure continuity of service". However, this initiative is too recent to be included in the March report, as "the request for authorisation of sites authorised on 1 April was received before this system was applicable", explains the ANFR.

 

Orange was the most dynamic in March, with 350 new sites, followed by SFR (276), Free (251) and Bouygues Telecom (83). The incumbent operator maintained its leadership in terms of the number of 4G sites operated (21,830), ahead of SFR (19,000), Bouygues Telecom (18,188) and Free (15,586).

 

The situation is slightly different in terms of the number of activated antennas. Orange is also the leader here with 1,481 new activations. On 22th November last, the Arcep adopted the procedures for allocating frequencies in the 3.5 Ghz band. Two days later, the government announced the reserve price below which it did not intend to transfer the first portion of spectrum dedicated to the 5G mobile network. And the operators make a face: the floor price seems far too high to them.

4 sets of 50 MHz allocated to each of the four operators at a fixed price of 350 million euros. Then 11 blocks of 10 Mhz that they will then compete at auction, bidding 70 million euros. 2.17 billion, while Orange, SFR, Bouygues Telecom and Free did not expect this reserve price to exceed The Arcep even campaigned for a prize of 1.5 billion "grand maximum".

In an interview at Les Echos, however, Agnès Pannier-Runacher presents this amount as "reasonable". In particular with regard to the sums paid by German or Italian operators. The representative of Bercy also argued that this figure corresponds to that determined by the Commission des Participations et Transferts, which "analyses the price below which the French people's assets do not seem to him to have to be sold".

 

A discourse that clashed with the operational and financial reality of 5G, reacted the operators. "This decision is not consistent with what has been put forward by the government in recent months," said Arthur Dreyfuss, President of the TFF. It constantly warns the State against a price boom that would deprive operators of the means to invest in deployment afterwards. Especially since the obligations assigned to them in return for the allocation of frequencies seem too ambitious.

 

5G frequencies too expensive: another dispute on the road to the future mobile network. Their disagreements relate not only to the reserve price, but also to the size of fixed-price blocks, the pace of deployment, 5G hedging obligations and the duration of licences. A non-exhaustive list of demands on which the regulator is far from having satisfied the Telecom Quartet.

 

Against the advice of Arcep, which favoured 60 MHz blocks, the state finally opted for 50 MHz. "With 50 MHz blocks, for a total of 310 MHz, the risk is that one operator will get twice as many frequencies as another," explained Sébastien Soriano, President of the Arcep, in Le Figaro. Bouygues Telecom and Free fear that they will lose out in the deal as they are less well equipped financially to bid higher.

Iliad also called for the removal of the third milestone in the deployment of 5G sites - 12,000 at the end of 2025 - for operators who would not obtain the famous 60 MHz. Arcep did not grant this right, but this obligation has been reduced to 10,500 sites. An adjustment reflecting the many criticisms encountered by the initial schedule. This assumed an acceleration of 1,000 sites per year from 2020 to 2022 and then to 2,500/year in 2023-2024 and 4,000/year in 2025 alone.

Bouygues Telecom, Orange and Free replied that they were unplayable, citing technical, financial and administrative constraints. Operators simply do not have the means to make the "leap" of 4,000 sites initially expected in 2025, argues Bouygues Telecom. For whom, moreover, "there is also no capacitive need of this magnitude on this horizon".

 

8,000 sites in 2024 and 10,500 in 2025 finally but not only in urban areas. The Arcep intends to ensure that the deployment of 5G will also benefit low-density areas, in line with government expectations. The regulator initially proposed to extend this obligation to the 22,000 municipalities of priority deployment areas (PDAs) as defined by the 2015 decision on the allocation of 700 MHz frequencies.

Again, there was no unanimity on this idea. Bouygues Telecom is not going about it in four ways: "Hedging obligations are very heavy and inconsistent with the object sold". For the operator, the 3.4-3.8 GHz band is intended for uses primarily for capacity, so that its use "is not relevant in sparsely populated areas".

Also mentioned by other actors, an approach consisting in prioritizing 5G deployments on "territories that we are sure will not benefit from FttH before a date to be determined". One of the approaches mentioned by Cerema or by the Assembly of French Departments is to use fixed 5G to compensate for future deficiencies in very high wireline broadband.

Finally, the opportunity to add the ZDP perimeter to the very recent list of "Industrial Territories" is suggested by several actors: Cerema again, but also Banque des Territoires or Orange. An addition finally retained by the Arcep in its specifications.

The last point of contention on the part of operators is the granting of 5G licences for an initial period of only fifteen years, which can be extended by five years after the Arcep's assessment. The Authority considers that this period is "appropriate to the level of investment required to fulfil the obligations under the procedure". Not Orange, Bouygues Telecom and SFR: the trio believes that this will not be enough to make their investments profitable.

When SFR was acquired by Numéricable in 2014, the parent company, Altice, made a number of commitments to the French Competition Authority in order to better promote this concentration in the telecoms sector. These commitments, which were entered into for a period of five years, should no longer be maintained, the gendarme said at the end of this period, on 28 October. The French Competition Authority has therefore released Altice from several of its commitments concerning:

  • the obligation to open the cable network to other operators, and not to use the information available to Altice to deploy its fibre network.
  • the prohibition on offering cable offers in La Poste branches with which SFR had a distribution agreement.
  • the maintenance of dark fibre (FON) or dedicated optical local loop (BLOD) offers "at least as advantageous as before the operation".

 

On the other hand, the competition police officer was more picky about the Faber contract concluded between SFR and Bouygues Telecom in 2010. A co-delivery agreement for the horizontal fibre optic network in 22 cities located in very dense areas (including Paris). Especially since Altice was called to order in 2017 because of "particularly serious breaches" of the execution of this contract. 40 million fine and injunctions to comply with deployment commitments co-financed by Bouygues Telecom.

The Authority decided to lift part of the injunctions: those, without penalty, requiring Altice to connect the buildings concerned by the agreement as from the 2017 decision. The competition police officer considers that Altice's interests are now "aligned with those of Bouygues Telecom" within the scope of the Faber contract. The parent company now favours FttH.

On the other hand, the injunctions under penalty payments for the stock of buildings that were to be fibrated before 2017 are maintained. The Authority is examining the progress of Patrick Drahi's group to determine whether it should also be released from these commitments. The auction framework for obtaining 5G frequencies has just been formalised by the Government. This framework letter, signed by the Minister for Cohesion of the Territories and the Secretary of State to the Minister of Economy, should enable Arcep to develop the process.


This letter defines in particular the constraints that will weigh on the winning operators. On the one hand, on the wallet side: it is a question of finding a "balance" between making the State's frequency assets grow and preserving the operators' capacity to invest in infrastructure. While both departments agree that "valuation should leave room for network development", they ask that "price is a substantial criterion for allocations".

On the other hand, on the coverage side: the Government warns that "the commercial service will have to be launched from 2020 to cover several cities" in return for the 5G licences awarded.

However, 5G deployment obligations will not be as stringent as those imposed to extend 4G last year throughout the country.


As for companies, the Arcep will have to "ensure that the operators who will benefit from authorisation will enable vertical players to apply for and benefit from 5G services under financial and operational conditions adapted to their needs, including in sparsely populated areas of the territory".

The Government has set the bar high by asking for the best of both worlds. It remains for the Arcep to include all this in the specifications of the 5G auctions scheduled for next autumn.

THD radio: manufacturers are asking for more time

Arcep has opened a window to allow local authorities to obtain THD radio frequencies and thus deploy this technology on their territories. The challenge is to be able to offer very high speed (minimum 30 Mb/s) to households with the lowest ADSL coverage and promised a late arrival of optical fibre. According to InfraNum, some 2.2 million households will be affected by 2022.


But here we are, only a handful of local authorities have obtained or requested dedicated frequencies. Indeed, the Federation reports a "deployment of the THD radio [...] under study or confirmed for nearly 40 departments" and notes that to date a "dozen departments" have not initiated any action.


InfraNum therefore sounds the alarm and asks Arcep to extend the opening of the THD radio counter by one year. The objective is to have more time to convince these communities to opt for a wireless solution. If other solutions exist, such as 4G setting up major national operators, the Federation warns that it will "not support, in addition, specific domestic or professional uses". And the prospect of a fixed 5G service is no more to be considered "waiting for its arrival to meet an immediate need for very high fixed broadband in rural areas is a decoy" warns Etienne Dugas, President of InfraNum....
