The Arcep is planing SFR

After ten months of proceedings, the Arcep ruled in favor of Bouygues Telecom regarding the wholesale prices charged by SFR FTTH to other national or regional operators. The latter are grafting themselves onto SFR's optical fiber network in the countryside in order to be able to offer this technology in areas where their own networks are less developed.

 

The Arcep was seized last January by Martin Bouygues' operator, after a price increase on the SFR side. Indeed, to access a "package" of SFR lines, operators had to pay 5.80 euros per line and per month, compared to 5.48 euros for Orange. Line rental prices had increased to 16.40 euros per month and per line.

SFR FTTH was able to increase its prices because, when it comes to optical fiber, only Orange's rates are regulated. For its part, Bouygues Telecom demanded two things: a return to the rates in effect before the February 1, 2020 increase and a reduction in line rental prices, with a range of 12.20 euros to 13.20 euros.

 

The regulator ruled in its favor on these two issues. SFR will therefore have to offer Bouygues Telecom an amendment to the contract to restore the old rates within one month. As regards line rental, SFR is required to propose a new tariff to Bouygues not to exceed 13.20 euros per month and per line.

 

This is a real setback for SFR, which by the end of 2018 had sold half of its fiber optic network in the three-fund campaigns. The latter had paid a very high price for this asset, no doubt enticed by the promise of high and long-term rental revenues.

But two years later, the operator had to lower its prices. In addition to this, Free has also filed a complaint with the Arcep on the same subject.

The Arcep, by putting an end to the call for tenders for 5G frequencies, has just delivered the positioning of operators on the 3.5 GHz band.

Only Free will have spent 3 million euros to secure a central position in the 5G "queen band". Iliad's French subsidiary will have access to 70 MHz of frequencies on a block ranging from 3.64 GHz to 3.71 GHz.

In detail, SFR will have 80 MHz of frequencies on a block ranging from 3.49 GHz to 3.57 GHz, while the 70 MHz of frequencies held by Bouygues Telecom will be located between 3.57 GHz and 3.64 GHz. Finally, Orange, which holds the largest block of frequencies, with 90 MHz of 5G frequencies, will have a block ranging from 3.71 GHz to 3.80 GHz.

 

During this second phase of the auction, the operators have disbursed a total of 2.78 billion euros. Bouygues Telecom paid 602 million euros to acquire 70 MHz of frequencies in the 3.5 GHz band, as did Free, which added 3 million euros to this sum to benefit from the positioning of its choice. For its part, SFR invested 728 million euros to get its hands on 80 MHz of frequencies, while Orange spent 854 million euros to get its hands on 90 MHz of frequencies in the 3.5 GHz band.

 

350 million spent by each operator to purchase fixed 50 MHz blocks will be reimbursed "in 15 equal parts over 15 years, the first part upon the award of the frequency license and the other 14 parts on the anniversary date of the award".

The amounts paid by the operators during the auction and positioning phase will be repayable "in four equal parts payable over four years, the first as soon as the authorization to use the frequencies is granted and the other three on the anniversary date of the grant".

"In addition to these sums, a variable annual portion equal to 1% of the revenues generated by the operation of these frequencies will be added to these amounts," said the telecom police officer.

The frequencies will be officially delivered by the Arcep as of November 18th. But operators will still have to wait for the ANFR's approval before they can market their first 5G offers to the general public and professionals, which should take about 10 additional days.

 

Concerning the marketing of 5G packages, the operators have not yet made their strategies known. In any case, they will have to wait for the approval of the municipalities to officially launch the 5G era among users. If patience is therefore required, operators are already beginning the major maneuvers to lower the cost of their 5G infrastructure.

Extension of the roaming agreement between Free and Orange

On October 23rd, the Arcep validated an amendment to the roaming contract that already bound the two operators. Free will thus be able to use Orange's 2G and 3G networks for its own commercial offers until December 31, 2022 instead of December 31, 2020. This is despite criticism from SFR, Bouygues Telecom or other alternative operators grouped within the Alternative Telecom association.

 

To justify its delay in deploying its own 2G and 3G infrastructures, the operator founded by Xavier Niel denounced the mutualization of networks signed in 2014 by Bouygues Telecom and SFR, the reinforced 4G deployment obligations imposed by the New Mobile Deal, and the lack of frequencies.

This argument hit the nail on the head with the Arcep, which nevertheless maintained the cap on the maximum upload and download speeds achievable by roaming customers at 384 kbits.

 

Even if the Arcep assures that it will "remain attentive to the continued investment by Free Mobile in the deployment of its own networks", this is not enough to calm the criticism of those opposed to this extension.

Starting with the management of SFR, for whom "ten years after obtaining its 3G license, this roaming agreement granted to Free Mobile is only the admission of a crying lack of investment by Free Mobile during all these years".

For its part, Bouygues Telecom points out that "roaming was designed from the outset as a transitional measure, with the sole aim of enabling the new entrant to compensate for its late entry into the market". However, "Free can no longer be described as a new entrant in the mobile telephony market" and "now has a network that is broadly comparable to that of its competitors, and therefore quite sufficient to enable it to compete vigorously" in the mobile market."

Alternative operators point out that the license granted to Free Mobile by the authorities was awarded "in exchange for ambitious commitments to stimulate competition".

 

These criticisms did not prevent the extension of the roaming agreement between Free and Orange. Even if Free's management is now tending to catch up in terms of deployment, it is not certain that this will be enough to calm the slings and arrows of its competitors. Especially since the recent statements of Orange's CEO concerning a possible mutualization of the two operators' 5G networks should not help to pacify the debate.

The Italian government has just vetoed, for the first time, the signature of an agreement between the operator Fastweb and Huawei for the supply of 5G network cores. This decision suggests that Italy may reconsider its position regarding the presence of Huawei equipment on its 5G network.

Huawei had been selected by Fastweb, the Italian division of Swisscom, as the sole supplier of the core network. A fact that undoubtedly led the government to veto the project.

 

While other countries such as the United Kingdom and France have already taken decisions to eventually ban Huawei's access to 5G networks, Italy had not yet taken a decision to do so. However, some people close to the government or actors in the industrial world claim that Rome is in fact taking a pro-American line on 5G. Companies using Huawei equipment for their 5G network are subject to restrictions on remote interventions to solve technical problems and an extremely high security threshold.

 

In order to be able to withdraw if Rome imposes too costly conditions in exchange for its green light, Italian telecom companies have included exit clauses in their contracts with Huawei on 5G. Telecom Italia (TIM) even went so far as to exclude Huawei from a tender for its 5G core network. The Italian government could therefore review its position regarding Huawei's role in 5G and in particular for the core network part.

5G: Huawei and ZTE banned from the Swedish network

After the United Kingdom in July, it was Sweden's turn to explicitly ban the Chinese groups Huawei and ZTE from its new future 5G telecoms network, invoking national security.

The decision was taken following a review by the Swedish Telecom Regulatory Authority (PTS), together with the army and intelligence, aimed at "ensuring that the use of frequencies does not endanger Sweden's security".

 

Huawei and ZTE will therefore be banned from all "central functions", i.e. more or less the entire network according to the inventory drawn up by the PTS. By 1 January 2025, all equipment already installed that could be used for 5G will have to be removed. This deadline is even shorter than the one set by London, which gave a deadline of 2027.

 

Leading the campaign against Huawei is the United States. Since the spectacular banning of the Chinese group by President Donald Trump in May 2019, Washington has been openly encouraging its European partners to do the same. The American intelligence services fear above all that Huawei will allow the Chinese authorities to use its equipment to monitor communications and data traffic. Huawei assures that it would refuse any such request from Chinese intelligence.

 

While Japan and Australia have followed the American movement, European positions remain widely divergent and the recommendations made by Brussels are non-binding. Without having expressed it publicly, France has in fact banned the use of Huawei equipment for 5G in "very dense zones". The periods of use of the equipment will also be limited to eight years.

 

Slovenia and Romania have also taken measures to facilitate the exclusion of Huawei from tenders. Spain, Poland and Greece, on the other hand, are planning to allow operators to use Huawei's equipment.

Plan of attack for the revival of Kosc

The wholesale operator, which took control of Kosc in the summer of 2020, is now preparing to relaunch it. And Kosc's rebound is bound to be closely scrutinised by the various players in the sector.

 

David El Fassy, the CEO of Altitude Infrastructure - now renamed Altitude Infra, explains, "For us, the acquisition of Kosc is an unprecedented opportunity to expand our client base in areas other than those where we have traditionally operated, particularly in AMII or urban areas. [...] After beating Kosc's order record in September, we now wish to enrich its catalogue of addressable FttE and FttO products, on which Kosc has not had a strong presence until now". Other objectives include the development of Kosc's coverage in SFR's AMII zones, with the eventual ambition to push for full unbundling of the wholesale operator.

 

Altitude Infra wants to make Kosc's API the most complete aggregator of telecommunications infrastructures, both for its major accounts (such as OVH) and also for VSEs. Indeed, the latter constitute the most important economic development basin of the corporate telecoms market.

To achieve this, the wholesale operator is planning a massive investment of 100 million euros over five years in Kosc. Xavier Grossetete, who has been working for Jaguar Network since 2017, has been appointed sales director and will be responsible for boosting the recruitment of new customers.

 

"With Kosc, we are becoming the operators' one-stop shop, with coverage throughout the country," says David El Fassy, confirming his intention "to invest and have a long-term influence on the fibre optics market, but also to develop new offers and services for companies". The plan proposed by Altitude Infra should enable Kosc to return to a positive Ebitda, as well as a turnover of between 80 and 100 million euros in 2022.

SFR condemned: no more doubt between cable and fibre

On October 8th, the Paris Court of Appeal ordered SFR to send a letter to certain subscribers informing them that they can unilaterally terminate their fixed Internet access contract. Capital tells us that if the operator resists, it will have to pay 500,000 euros for each day of delay.

 

This legal procedure was initiated in January 2018 by its competitor Free. Indeed, although a decree has regulated the use of the word fibre since 2016, SFR has continued to maintain a certain vagueness in its commercial offers.

It is also accused of using the term FttB (Fiber to the Building) since, in some cases, its fiber does not go all the way down to the bottom of the building but only into a street cabinet.

 

Today SFR claims to have 3.1 million end-to-end fibre optic customers (FttH) and 13.8 million lines eligible for Very High Speed broadband.

On the evening of the second day of the auction, the State is already assured of pocketing at least €2.65 billion for the allocation of 5G frequencies in France.

 

Organised by Arcep, the auction covers eleven 10 MHz blocks coveted by Bouygues Telecom (Bouygues), Orange, Free (Iliad) and SFR (Altice).

Each of the 10 MHz blocks, put up for sale at a minimum price of €70 million, reached a new price of €114 million on the evening of 30 September. It had already risen to 90 million on the first day of the auction the day before. The Arcep specifies that the process will continue on Thursday.

 

Having already raised 1.4 billion euros during the non-auction allocation of four 50 MHz blocks - one per operator - the amount reached by the auction guarantees 2.65 billion euros to the State for the moment. Orange is still asking for five blocks, followed by SFR and Bouygues Telecom with three blocks each, then Iliad with just two blocks.

Fibre is (finally) winning the SME/VSE market

Internet access has become a critical issue for small businesses. From the fibre dedicated to simple ADSL/SDSL access, when it is not a simple consumer internet box, there is a direct correlation between the size of the company and the quality of internet access. VSEs and artisans often have a poor perception of the need to pay a pro subscription that is more expensive than their domestic access, until their offices are deprived of Internet access for several days while their operator troubleshoots them.

 

Different options are available to the entrepreneur. On the one hand, the pro offers of all the major national operators. These are catalogue products that are ultra-standardised and industrialised. In addition to an HT invoicing, these packages offer some interesting SLAs, in particular an intervention within 8 hours in case of breakdown, a customer support dedicated to professionals, sometimes a backup of the fixed link with a 4G router. The very competitive cost is mainly due to the fact that they are based on the telecom infrastructures of the consumer network, ADSL/SDSL or VDSL on the copper network or FTTH/EPON for the fibre.

 

But the other side of the coin is that these offers are not very flexible. The company has to comply with what the package offers. A company wishing to benefit from more personalised services must turn to company type operators capable of customised solutions.

On this market cohabit large international operators such as Verizon and Deutsche Telekom but also a multitude of regional or national operators such as Avenir Telecom, Bretagne Telecom, Coriolis, Foliateam, Hexatel, Kertel, Teleris or even OVH. The interest for an SME to turn to a purely B2B operator with a strong regional presence is to be able to benefit from integration services that go beyond the simple installation of the fibre.

These small players compete with the major operators and their integrators by offering companies local services and the ability to maintain a very close technical and commercial link with their customers.

 

Today, these "small" operators are seeking to break through their regional glass ceiling, either by making acquisitions or by turning to external sources of financing. If there is no clear consolidation of the market around the incumbent operators, the French players positioned on the fibre market are obtaining significant financing to develop, and the cards are being reshuffled, particularly on this fibre market.

The challenge for the market players is to recreate value and that is why we are seeing a lot of fund-raising and a change of shareholders. Fibre requires large investments, but it will be the key to offer new offers to companies and finally see very high speeds arrive in all companies, including the most modest.

Following complaints about service degradation, two years ago the Arcep gave the incumbent operator formal notice to meet its commitments in 2019. While clear progress was made in 2019, the situation is less satisfactory in the first half of 2020, which is marked in particular by the health crisis. The telecoms gendarme is waiting with bated breath for the improvement promised by the incumbent operator in the second half of the year.

 

"The health protection measures remain in force and bring constraints during interventions that reduce the productivity of Orange's resources," Orange pleaded in a press release last July.

 

As a reminder, at the end of 2017, the incumbent operator was charged with providing a fixed-line telephone offer to all French citizens at an affordable price for a period of three years. It is subject to a dozen service quality indicators listed in the specifications, which include annual numerical thresholds controlled by Arcep.

The alternative operator has just announced that it has raised more than €500 million in equity and junior debt from a pension fund to ensure the deployment of a fibre optic network and the recovery of Kosc.

Subject to approval by the regulatory and competition authorities, these two transactions are expected to be finalised in the fourth quarter of 2020. "These two transactions demonstrate our ambition in the fibre market in France and beyond. In a context of sector consolidation, these investments will enable us to pursue our growth strategy with the aim of strengthening our position as the leading independent operator", said David Elfassy, President of Altitude Infrastructures.

 

The takeover of Kosc should now enable Altitude Infrastructure to develop its addressable customer base in very dense and moderately dense areas, where the bulk of the Wholesale-only operator's business is located, which claims around ten million eligible outlets in these areas.

The alternative infrastructure operator is also planning a massive investment of 100 million euros over five years in Kosc. With this new fund raising, this welcome injection of capital now has all the green lights. As a reminder, the plan proposed by Altitude Infrastructure would enable Kosc to aim for a return to a positive Ebitda and a turnover of between 80 and 100 million euros in 2022.

Five years after the adoption of the regulation enshrining net neutrality on the Old Continent, the Court of Justice of the European Union is beginning to give it a legal interpretation. It validates the analysis that "free traffic" (or "zero rating") as applied by operators constitutes a violation of net neutrality.

 

In 2016, the Body of European Regulators for Electronic Communications (BEREC) published guidelines on net neutrality which are binding on all its members. These guidelines make it very difficult in practice to use zero rating, even if it is not formally prohibited.

 

"Free traffic" is a commercial practice whereby an operator does not charge or account for the use of certain online services, even if they are used by the Internet user.

Although at first sight these offers may seem attractive, they pose various problems: the internet user does not have control over the choice of services selected. Above all, however, the zero rating could hinder or block access to rival platforms, thus distorting competition, according to the logic of commercial agreements between Internet access providers and content providers.

 

In this case, everything starts from Hungary with the Norwegian ISP Telenor, which proposed two access bundles with zero rating. Once the mobile data had been exhausted, Internet users could continue to use their access for the zero-rated services, while the other solutions were subject to a technical restriction by the operator.

After monitoring by the Hungarian Communications and Media Authority, it found that these subscriptions were in breach of the general obligation of equal and non-discriminatory treatment of traffic. It therefore naturally demanded that Telenor put an end to them.

 

However, the Norwegian ISP appealed to the court in Budapest and the latter asked the EUJC during the investigation to find out how to correctly read the European regulation establishing measures relating to open Internet access.

 

In the summary of the judgment, the ECJ stated that "the requirements of protection of the rights of Internet users and of non-discriminatory treatment of traffic preclude an ISP from favouring certain applications and services by means of offers which make those applications and services benefit from a zero tariff and subject the use of other applications and services to blocking or slowing down measures".

 

Nevertheless, is the European Court of Justice slashing the zero rating once and for all? Not really: the CJEU's call to order concerns very specifically decisions based on commercial considerations". Where measures to slow down or block traffic are based not on objective differences between the technical requirements in terms of quality of service for specific categories of traffic, but on commercial considerations, such measures are to be regarded, as such, as incompatible with the said provision", writes the CJEU Press Service.

A zero rating on a category of traffic or use may be envisaged by an operator. However, what is prohibited is selective zero rating.
